29 CFR 1904.32(b)(3): A company executive did not certify that he or she has examined the OSHA 300 Log and that he or she reasonably believes, based on his or her knowledge of the process by which the information was recorded, that the annual survey is correct and complete: (a) Jacobs Entertainment Inc dba The Lodge Casino at 240 Main St, Black Hawk, CO 80422: On and before June 6, 2011, a company executive did not certify that he or she has examined the OSHA 300 Log and that the annual survey was correct and complete for calendar years 2009 and 2010. Abatement Note: The company executive who certifies the log must be one of the following persons: (1) An owner of the company (only if the company is a sole proprietorship or partnership); (2) An officer of the corporation; (3) The highest ranking company official working working at the establishment; or, (4) The immediate supervisor of the highest ranking company official working at the establishment. 29 CFR 1910.1030(c)(1)(i): The employer having employee(s) with occupational exposure did not establish a written Exposure Control Plan designed to eliminate or minimize employee exposure: (a) Jacobs Entertainment Inc dba The Lodge Casino at 240 Main St, Black Hawk, CO 80422: On and before June 6, 2011, the employer did not establish a written Exposure Control Plan for employees having occupational exposure to blood or other potentially infectious material (OPIM). Houskeeping staff and security personnel are required to clean blood and OPIM from gaming equipment during the course of their normal work duties. This condition potentially exposes employees to blood and OPIM. Abatement Note: The Exposure Control Plan shall contain at least the following elements: (1) The exposure determination required by paragraph (c)(2); (2) The schedule and method of implementation for paragraphs (d) Methods of Compliance, (e) HIV and HBV Research Laboratories and Production Facilities, (f) Hepatitis B Vaccination and Post-Exposure Evaluation and Follow-up, (g) Communication of Hazards to Employees, and (h) Recordkeeping, of this standard; and, (3) The procedure for the evaluation of circumstances surrounding exposure incidents as required by paragraph (f)(3)(i) of this standard. Abatement Note: Abatement certification is not required for this item.

29 CFR 1910.1030(d)(4)(ii)(A): Contaminated work surfaces were not decontaminated with an appropriate disinfectant after completion of procedures: (a) Jacobs Entertainment Inc dba The Lodge Casino at 240 Main St, Black Hawk, CO 80422: On and before June 6, 2011, the employer did not ensure that work surfaces were decontaminated with an appropriate disinfectant in that employees use Crew Restroom Floor and Surface Non-Acid Disinfectant Cleaner to disinfect felt gaming tables. This chemical is not used according to the manufacturer's instructions. This chemical is for use on hard, non-porous surfaces. This condition potentially exposes the employees to blood or other potentially infection material. Abatement Note: Abatement certification is required for this item (see enclosed Sample Abatement Certification Letter).

29 CFR 1910.1030(g)(2)(vii)(J): The bloodborne pathogens training program did not contain information on the appropriate actions to take or persons to contact in an emergency involving blood or other potentially infectious materials: (a) Jacobs Entertainment Inc dba The Lodge Casino at 240 Main St, Black Hawk, CO 80422: On and before June 6, 2011, the employer did not ensure that work surfaces were decontaminated with an appropriate disinfectant procedure. Employees use Crew Restroom Floor and Surface Non-Acid Disinfectant Cleaner to disinfect gaming chips and tables, floors, walls and other surfaces contaminated with blood or other potentially infectious materials. Employees wipe the solution off the contaminated surface immediately or wait up to two minutes before wiping. The manufacturer requires 10 minutes of contact time. This condition potentially exposes the employees to blood or other potentially infectious materials. Abatement Note: Abatement certification is required for this item (see enclosed Sample Abatement Certification Letter).
