A stairway, ladder, ramp or other safe means of egress shall be located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees: a. On or about June 17, 2011, at the above addressed jobsite, an employee installing a water line in a trench, eight (8) feet four (4) inches deep, was not provided a safe means of egress.

29 CFR 1926.651(i)(3): Sidewalks, pavements and appurtenant structure shall not be undermined unless a support system or another method of protection is provided to protect employees from the possible collapse of such structures: a. On or about June 17, 2011, at the above addressed jobsite, an employee was installing a water line in a trench measured at eight (8) feet four (4) inches in depth. The trench undermined the street. The street was not supported nor provided a means of protection from the possible collapse of the street, thereby exposing the employee to cave in hazards.

On or about June 17, 2011, at the above addressed jobsite, an employee was installing a water line in a trench measured at eight (8) feet four (4) inches in depth. The trench was not provided with adequate cave in protection, threby exposing the employee to cave in hazards. b. On or about June 17, 2011, at the above addressed jobsite, an employee was installing a water line in a trench measured at nine (9) feet in depth. The trench was not provided with adequate cave in protection, thereby exposing the employee to cave in hazards.

29 CFR 1926.652(g)(2): Additional requirement for shield systems used in trench excavations. Excavations of earth material to a level not greater than 2 feet (.61 m) below the bottom of a shield shall be permitted, but only if the shield is designed to resist the forces calculated for the full depth of the trench, and there are no indications while the trench is open of a possible loss of soil from behind or below the bottom of the shield: a. On or about June 17, 2011, at the above addressed jobsite, an employee was installing a water line in a trench measured at eight (8) feet four (4) inches in depth and four (4) feet of soil was below the trench sheild, thereby exposing the employee to cave in hazards.
