29 CFR 1926.652(c)(2)(iii): Manufacturer's specifications, recommendations, and limitations, and manufacturer's approval to deviate from the specifications, recommendations, and limitations shall be in written form at the jobsite during construction of the protective system. After that time this data may be stored off the jobsite, but a copy shall be made available to the Secretary upon request. a. On or about August 22, 2012, at the above addressed jobsite, employees were conducting water taps in a trench measuring seven (7) feet five (5) inches in depth. The employer did not provide to the Secretary upon request the Manufacturer's specification of the screw jack shoring system.

29 CFR 1926.652(e)(2)(i): Excavation of material to a level no greater than 2 feet (.61 m) below the bottom of the members of a support system shall be permitted, but only if the system is designed to resist the forces calculated for the full depth of the trench, and there are no indications while the trench is open of a possible loss of soil from behind or below the bottom of the support system. a. On or about August 22, 2012, at the above addressed jobsite, an employee installing a water line in a trench measuring seven (7) feet five (5) inches , had approximately three feet of unprotected soil below the shoring, thereby exposing the employees to cave in hazards. THE GARCES CONTRACTORS LLC., WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.652(E)(2)(I), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 191358, CITATION NUMBER 1, ITEM NUMBER 4 AND WAS AFFIRMED AS A FINAL ORDER ON JULY 11, 2012, WITH RESPECT TO A WORKPLACE LOCATED AT 11928 S PERRY AVE., CHICAGO, IL 60651. THE GARCES CONTRACTORS LLC., WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.652(G)(2), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 77192, CITATION NUMBER 1, ITEM NUMBER 3B AND WAS AFFIRMED AS A FINAL ORDER ON SEPTEMBER 20, 2011, WITH RESPECT TO A WORKPLACE LOCATED AT 1832 WEST 21ST STREET, CHICAGO, IL 60608.
