29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them): a) ACC Roofing, Inc. at 1117 18th St, Greeley, CO 80631: On and before June 29, 2011, the controlling employer did not ensure a safety program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Three subcontractor employees were working next to the edge of the roof on a one-story residential home without the use of a fall protection system. The subcontractor employees were removing flashing on the portion of the flat roof on the north side of the home. This condition exposed subcontractor employees to a fall hazard of approximately 20 feet to the ground below. b) ACC Roofing, Inc. at 1117 18th St, Greeley, CO 80631: On and before June 29, 2011, the controlling employer did not ensure a safety program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Subcontractor employees accessed the roof by using two extension ladders on the west side of the house. One extension ladder was used to access the 1st level of roof while the other was used to access the top flat portion of the roof. Both ladders were placed less than three feet above the landings. This condition exposed subcontractor employees to a fall hazard of approximately 10 feet to the ground below. ACC Roofing, Inc. was previously cited for a violation of the same or substantially similar condition of this Occupational Safety and Health Standard 29 CFR 1926. 20(b)(2) which was contained in OSHA Inspection Number 313410714, Citation 1, Item 1, issued on September 25, 2009, and became Final Order on November 13, 2009 with respect to a workplace located at 1801 Avery Plaza St., Severance, CO 80546.
