Section (5)(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a) At Crary Industries located in West Fargo, ND, for employees exposed to a potential amputation hazard while operating the Aida 100-ton mechanical punch press, serial #00110-1357, created by a lack of training in machine operation and hazard recognition and avoidance. Reference ANSI B11.1-2001 Safety Requirements for Mechanical Power Presses, Part 9.5 Training: The user shall establish personnel training programs that are identified in paragraphs (1) thorough (5) of this part.

29 CFR 1910.212(a)(3)(ii): Point(s)-of-operation of machinery were not guarded to prevent employee(s) from having any part of their body in the danger zone(s) during operating cycle(s): (a) At Crary Industries in West Fargo, ND, for employees operating the Aida 100-ton mechanical press brake, serial #00110-1357, from a foot control and point-of-operation guarding had not been provided exposing employees to a potential amputation hazard. Crary Industries was previously cited for a violation of this occupational safety and health standard, or its equivalent standard, 29 CFR 1910.212(a)(3)(ii), which was contained in OSHA Inspection Number 312230709, Citation Number 1, Item Number 6, and was affirmed as a final order on September 26, 2008, with respect to a workplace located at 237 12th Street NW, West Fargo, ND.
