29 CFR 1910.184(c)(13): The employer loaded a sling in excess of its recommended safe working load as prescribed by the sling manufacturer on the identification marking permanently affixed to the sling. (a) On December 7, 2022, at 237 12th Street NW in West Fargo, North Dakota. Employees operating an overhead crane, using a Safe Way synthetic web sling rated for a 5,000 pound choker hitch. The sling was loaded beyond its rated capacity resulting in sling failure.

29 CFR 1910.179(b)(8): Employee(s) other than designated personnel were permitted to operate crane(s): (a) On December 7, 2022, at 237 12th Street NW in West Fargo, North Dakota, prior to designating employees to use overhead cranes, the employer did not ensure employees had the skills, knowledge, and ability required to operate the crane in a safe manner. An employee was operating an overhead crane which resulted in employee exposure to struck-by, caught in-between, and/or pinch point hazards.
