29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents: a) Phoenix Framing LLC at 9642 East 3rd Avenue, Denver CO 80230: On or before 7/23/11, the employer did not ensure that subcontractor employees were wearing safety glasses in the following instances: 1) An employee was using a pneumatic nail gun without the use of safety glasses; 2) An employee was disconnecting roof trusses from the crane's hook and ball without the use of safety glasses; and 3) An employee was using a tag line to guide the roof trusses without the use of safety glasses. Conditions exposed employees to the hazards of eye injuries from projectiles and sharp objects. Abatement note: Abatement certification is required for this item (See enclosed "Sample Abatement-Certification Letter").

29 CFR 1926.501(b)(13): Employees engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system: a) Phoenix Framing LLC at 9642 East 3rd Avenue, Denver CO 80230: On or before 7/23/11, the employer did not ensure that subcontractor employees were protected from falling. Two subcontractor employees were walking and working from the exterior top plate of the second floor to set roof trusses without the use of fall protection. Conditions exposed employees to fall hazards. Abatement note: Abatement certification and documentation are required for this item (See enclosed "Sample Abatement-Certification Letter").
