29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels were not protected by guardrail systems, safety net system, personal fall arrest system, or other approved alternative fall protection system: (a) On or before February, 1, 2023 the controlling employer did not ensure that subcontractor employees were protected from injury, in that four subcontractor employees erecting exterior walls on the second level worked near the edge without utilizing a fall protection system. Guardrails were not used in a section where the subcontractor employees were working. The opening was approximately 20 feet in width and exposed employees to a fall hazard of approximately 15 feet to the ground. This condition exposed subcontractor employees to fall hazards of 15 feet.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who might be exposed to fall hazards: (a) On or before February 1, 2023, the employer did not ensure employees were trained to recognize the hazards of working at elevation and trained in the use of fall protection in that the controlling employer did not ensure that each subcontractor employee engaged in framing operations was trained to recognize the hazards of working at elevation and trained in the use of fall protection. This exposed subcontractor employees to fall hazards ranging from 11 to 15 feet. Abatement Note: The employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the following areas: a) The nature of fall hazards in the work area; b) The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used; c) The use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used; d) The role of each employee in the safety monitoring system when this system is used; e) The limitations on the use of mechanical equipment during the performance of roofing work on low-sloped roofs; f) The correct procedures for the handling and storage of equipment and materials and the erection of overhead protection; and g) The role of employees in fall protection plans; h) The standards contained in this subpart.

1926.21(b)(2) The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: (a) On or before February 1, 2023, the employer did not ensure that eye and face protective equipment were used when a subcontractor employee operated a pneumatic nail gun presented potential eye or face injury from physical agents in that the subcontractor employee was exposed to struck-by hazards not wearing eye protection while using a pneumatic nail gun.
