(a) Marazon Enterprises, LLC on or about August 23, 2011, at the address of 2456 Barrington St. Toledo, OH: The employer did not ensure employees were protected from head injuries while working below employees conducting roofing work above. Employees were exposed to potential impact injuries caused from falling material and/or equipment.

29 CFR 1926.451(g)(1)(i): Each employee on a boatswains\' chair, catenary scaffold, float scaffold, needle beam scaffold, or ladder jack scaffold was not protected by a personal fall arrest system.    Marazon Enterprises, LLC on or about August 23, 2011, at the address of 2456 Barrington St. Toledo, OH: The employer failed to ensure employees were protected from a fall while working from a ladder jack scaffold.  Employees were exposed to a near 18 ft fall to the level below during roofing operations of a residential structure. No form of fall protection was in place.

Marazon Enterprises, LLC on or about August 23, 2011, at the address of 2456 Barrington St. Toledo, OH: The employer did not ensure employees were protected from falls while removing old roofing material from a residential type structure.  Employees were exposed to an 18 ft fall to the ground below.

29 CFR 1926.503(b)(1): The employer did not verify compliance with paragraph (a) of this section by preparing a written certification record.     a)  Marazon Enterprises, LLC on or about August 23, 2011, at the address of 2456 Barrington St., Toledo, Ohio:  The employer did not develop or maintain a written record of certification for all employees who might be exposed to fall hazards. It had been evaluated during employee and employer interviews that exposed employees had been trained, though the employer could not produce a written certification of their training.
