29 CFR 1915.14(a)(1)(i): The employer did not ensure that hot work was not performed in or on any confined or enclosed spaces and other dangerous atmospheres, or boundaries of spaces or pipelines until the work area had been tested and certified by a Marine Chemist or a U.S. Coast Guard authorized person as "Safe for Hot Work", within, on, or immediately adjacent to spaces that contain or have contained combustible or flammable liquids or gases. a) Welding was performed on confined and enclosed spaces immediately adjacent to spaces that contained or had contained fuel on the fishing vessels Pacific Storm and Last Straw, and the work area had not been tested and certified by a Marine Chemist or a U.S. Coast Guard authorized person.
