29 CFR 1926.102(a)(1): Employees shall be provided with eye and face protection equipment when machines or operations present potential eye or face injury from physical, chemical, or radiation agents:    (a) A C Roofing Contractor at 725 Lincoln Ave. in Steamboat Springs, CO: On and before September 9, 2011 the exposing employer did not provide and require the use of eye protection when roofers were exposed to eye hazards in that the roofers were not wearing safety glasses when tearing off old roofing materials manually or when using nail guns.  This exposed the workers to an eye hazard.    Abatement Note:  Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR 1926.20(b)(2):  The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person:    a) A C Roofing Contractor LLC at 725 Lincoln Ave. in Steamboat Springs, CO:  On and before September 9, 2011 the exposing employer did not ensure a safety program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. The company owner and nine roofers were working on the roof of a three story hotel without the use of a fall protection system. This condition exposed the roofers to a fall hazard of approximately 30 feet to the ground below.    Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.    Abatement Note:  Abatement certification and documentation are required for this item (see enclosed "Certification of Corrective Action Worksheet").    A C Roofing Contractor LLC was previously cited for a violation of the same or substantially similar condition of this Occupational Safety and Health Standard 29 CFR 1926. 20(b)(2) which was contained in OSHA Inspection Number 313016222, Citation 1, Item 1-b, issued on August 11, 2010, and became Final Order on September 7, 2010 with respect to a workplace located at 805 Woodland Dr. in Maryville, IL.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:    (a) A C Roofing Contractor LLC at 725 Lincoln Ave. in Steamboat Springs, CO: On and before September 9, 2011 each employee on a roof with unprotected sides 6 feet or more above the ground was not protected from falling by use of guardrail systems, safety net systems, or personal fall arrest systems in that the exposing employer did not use fall protection and did not ensure that his crew were protected from falls while repairing the roof of the Hampton Inn.  This condition exposed the exposing employer and roofers to falls of up to approximately 30 feet.    Abatement Note:  Abatement certification and documentation are required for this item (see enclosed "Certification of Corrective Action Worksheet").    A C Roofing Contractor LLC was previously cited for a repeated violation of the same or substantially similar condition of this Occupational Safety and Health Standard 29 CFR 1926. 501(b)(1) which was contained in OSHA Inspection Number 313016222, Citation 2, Item 1, issued on August 11, 2010, and became Final Order on September 7, 2010 with respect to a workplace located at 805 Woodland Dr. in Maryville, IL.

29 CFR 1926.503(a)(1) The employer did not provide a training program for each employee who might be exposed to fall hazards:    (a) A C Roofing Contractor LLC at 725 Lincoln Ave. in Steamboat Springs, CO:  On and before September 9, 2011 the exposing employer did not provide a training program for each employee who might be exposed to fall hazards.  The employer adn nine employees were working on the roof of a three story hotel without the use of a fall protection system. This condition exposed the roofers to a fall hazard of approximately 30 feet to the ground below.    Abatement Note: The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  When the employer has reason to believe that any affected employee who has already been trained does not have the understanding and skill required the employer shall retrain each such employee.  Retraining is required when there are inadequacies in the employee's knowledge or use of fall proteciton systems or equipment.    Abatement Note:  Abatement certification and documentation are required for this item (see enclosed "Certification of Corrective Action Worksheet").
