29 CFR 1910.120(q)(8)(i): Employees who were trained in accordance with 29 CFR 1910.120(q)(6) did not receive annual refresher training of sufficient content and duration to maintain their competencies or did not demonstrate competency in those areas at least yearly:      a.  On or about October 18, 2011,  in the facility,  employees who were required to respond to anhydrous ammonia releases at the hazardous materials technician level in accordance with 29 CFR 1910.120(q)(6) had not received annual refresher training to maintain their competencies.  Two employees of the Emergency Response Team did not have annual refresher training since the initial 24 Hour Hazardous Material Technician training on July 7-9, 2008.

The employer did not perform a workplace hazard assessment, select and have each affected employee use PPE, communicate selection decisions to each affected employee, train each affected employee and verify that the required hazard assessment was performed.
