29 CFR 1926.760(a)(1):  Each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet above a lower level shall be protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems or fall restraint systems:    (a)  A&M Steel, Inc. at 3494 Eagle Prairie Blvd, Brighton, CO 80601:  On October 6, 2011, the exposing employer did not ensure that employees welding and screwing down metal decking on top of the 2nd level of the metal structure were protected from fall hazards. Three employees were wearing fall harnesses; however, the lanyards attached to the harnesses were not connected to the fall protection system anchors. The employees were securing the decking due to windy conditions. This condition exposed the employees to a fall hazard of approximately 19 feet.

29 CFR 1910.134(c)(2)(i):  Where respirator use was not required, and where the employer determined that voluntary respirator use was permissible, the employer did not provide the respirator users with the information contained in Appendix D to this section ("Information for Employees Using Respirators When Not Required Under the Standard"):    (a)  A&M Steel, Inc. at 3494 Eagle Prairie Blvd, Brighton, CO 80601:  On and before October 6, 2011, where respirator use was not required, and where the employer permitted the voluntary use of N-95 filtering facepiece respirators and half-face, cartridge style, tight fitting respirators, the employer did not provide the respirator users with the information contained in  Appendix D to this section ("Information for Employees Using Respirators When Not Required Under the Standard").    Note:  The requirements applicable to construction work under 1926.103 are identical to those set forth at 29 CFR 1910.134 of this chapter.

29 CFR 1910.134(d)(1)(iii):  The employer did not identify and evaluate the respiratory hazard in the workplace:    (a)  A&M Steel, Inc. at 3494 Eagle Prairie Blvd, Brighton, CO 80601:  On and before October 6, 2011, the exposing employer did not identify and evaluate the respiratory hazard in the workplace, in that employees were potentially exposed to the inhalation of welding and metal fumes while mig and stick welding different types of steel and metals, both indoors and outdoors. This condition potentially exposed employees to the hazards of inhalation of harmful fumes.    Note:  The requirements applicable to construction work under 1926.103 are identical to those set forth at 29 CFR 1910.134 of this chapter.
