This conduction exposed employees to struck-by hazards.

29 CFR 1926.1412(h): Equipment not in regular use. Equipment that has been idle for 3 months or more must be inspected by a qualified person in accordance with the requirements of paragraph (e) (Monthly) of this section before initial use: (a) On or about August 9, 2023, the employer did not ensure that a wheeled telescopic boom crane was inspected by a qualified person, after being out of use for approximately seven months, prior to the equipment lifting steel beams into position as part of a steel erection operation. This conduction exposed employees to struck-by hazards.

29 CFR 1926.1417(q): The equipment must not drag or pull loads sideways: (a) On or about August 9, 2023, the employer utilized a wheeled telescopic boom crane to drag a steel beam along the ground. This action caused the crane's outrigger, front tire, and rear dually tires, which were located on the side of the crane opposite the load, to lift approximately one foot off the ground. This condition exposed employees to struck-by hazards.
