29 CFR 1910.134(c)(2)(i): The employer determined that respirator use by employees was permissible and did not provide the employees with information contained in Appendix D of this section: (a) Nichols Tillage Tools, Inc. @ 312 Hereford Ave., Sterling, CO 80751: On and before 11/8/11, the employer did not provide employees with the information that is contained in Appendix D. An employee was allowed to voluntarily use a Sperian half-face, air purifying respirator, equipped with P100 cartridges at their discretion.

29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement elements of a written respiratory protection program necessary to ensure that any employee using a respirator voluntarily is medically able to use that respirator, and that the respirator is cleaned, stored, and maintained so that its use does not present a health hazard to the user: (a) Nichols Tillage Tools, Inc. @ 312 Hereford Ave., Sterling, CO 80751: On and before 11/8/11, the employer did not ensure that an employee equipped with a company-purchased Sperian half-face, air purifying respirator was medically capable to use the respirator prior to use.
