29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns. On October 27, 2011 two employees were not protected by hard hats while working in a trench, exposing them to struck-by hazards. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. On October 27, 2011 employees were exposed to the hazards associated with a spoil pile that was not kept at least two feet from the trench edge. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c) of this paragraph. On October 27, 2011 employees were not protected from a cave-in while working in an unprotected trench, exposing them to the hazards associated with a cave-in. Moss Sewer & Water, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1) which was contained in inspection number 315419630, citation number 1, item number 4, and was affirmed as a final order on June 23, 2011, with respect to a work place located at 1250 Campground Rd. Des Plaines, IL. 60016. In accordance with CFR 29 1903.19(d) abatement documentation is required of this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
