29 CFR 1926.600(a)(3)(ii): Whenever the equipment was parked, the parking brake was not set: (a) Near the front of the house on or about November 2, 2011, and at times prior thereto, the parking brake was not set on a Caterpillar 416 Series II backhoe. The operator was not onsite, and the motor was off. Employees walked next to the backhoe to access the project.

29 CFR 1926.451(e)(1): When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface were not used: (a) Near the center of the house on or about November 2, 2011, and at times prior thereto, there was no safe access to a 51.5 inch high scaffold platform. Employees climbed on CMUs that were placed on end. Employees on the scaffold laid CMUs to build a wall.

29 CFR 1926.601(b)(14): All vehicles in use were not checked at the beginning of each shift to assure that the following parts, equipment, and accessories were in safe operating condition and free of apparent damage that could cause failure while in use: service brakes, including trailer brake connections; parking system (hand brake); emergency stopping system (brakes); tires; horn; steering mechanism; coupling devices; seat belts; operating controls; and safety devices. All defects were not corrected before the vehicle is placed in service. These requirements also apply to equipment such as lights, reflectors, windshield wipers, defrosters, fire extinguishers, etc., where such equipment is necessary: (a) Near the front of the house on or about November 2, 2011, and at times prior thereto, there was no control mechanism for the horn on a Caterpillar 416 Series II backhoe. The backhoe was used to move soil around the site.
