29 CFR 1926.501(b)(1): Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level was not be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: (a) On the roof of the structure for the generator on or about November 3, 2011, and at times prior thereto, there was no fall protection for an employee applying plaster to the fascia. The roof was about 9 feet, 1 inch above the ground.

29 CFR 1926.1051(a): A stairway or ladder was not provided at all personnel points of access where there is a break in elevation of 19 inches (48 cm) or more, and no ramp, runway, sloped embankment, or personnel hoist is provided: (a) At the structure for the generator on or about November 3, 2011, and at times prior thereto, there was no safe access to the roof. An employee was on the roof applying plaster to the fascia. The roof was about 9 feet, 1 inch above the ground. The employee stepped off the roof, onto the top of a concrete fence, into an opening for a window in the generator structure.
