29 CFR 1910.120(q)(1): The employer, who would evacuate employees from the danger area when an emergency occurred and would not permit any employees to assist in handling the emergency, did not provide an emergency action plan in accordance with 1910.38(c): (a) The employer's Site Emergency Plan did not address potential emergency conditions which could result from toxic chemical release involving sanitation chemicals, such as ZEP 4665 and ZEP 4089 (alkaline chlorinated compounds) and ZEP Sizzle Brite (acid), which were kept and used during 3rd shift in the Chemical Room of the West Building by Contract Services Limited. An emergency condition of this type occurred on or around November 29, 2011, apparently when alkaline chlorinated compound was inadvertently combined with acid, resulting in a chemical reaction and release of hazardous decomposition products.

29 CFR 1910.165(b)(1): The employee alarm system did not provide warning for necessary emergency action as called for in the emergency action plan, or for reaction time for safe escape of employees from the workplace or the immediate work area, or both: (a) In the West Building, on or around November 29, 2011, when a chemical release emergency occurred involving sanitation chemicals stored and used by Contract Services Limited, no alarm was sounded to alert workers of the necessity to evacuate.
