29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (B) & (C): On or about 11/29/11 during the installation of a water main, the employer did not ensure an employee was protected from a cave in while working in an excavation that measured 7 to 8 foot in depth, 13 feet in length, and 8 to 9.5 feet in width. MARKS CONSTRUCTION INC., WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD CFR 1926.652(A)(1), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 310903943, CITATION NUMBER 01, ITEM NUMBER 01 AND WAS AFFIRMED AS A FINAL ORDER ON 06/13/07, WITH RESPECT TO A WORKPLACE LOCATED AT CORNER OF GRAFTON RD. & SUB STATION BRUNSWICK, OHIO 44139.
