On or about August 24, 2023, and at other times thereafter, during a sewer line replacement at a worksite located near 270 N Main Street, Chagrin Falls, OH 44022, the employer did not remove an exposed employee from the hazardous area after indications of the failure of a protective system was identified by a "competent" person.

29 CFR 1926.652(a)(1):Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: On or about August 24, 2023, and at other times thereafter, during a sewer line replacement at a worksite located near 270 N Main Street, Chagrin Falls, OH 44022, the employer did not ensure an employee working inside a trench, with depths up to approximately 12.6 feet, was protected from cave-ins by an adequately designed protection system. The soil would have been classified as; Type "B".
