29 CFR  1926.651(k)(1):An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift:  On or about August 24, 2023, and at other times thereafter, during a sewer line replacement at a worksite located near 270 N Main Street, Chagrin Falls, OH 44022, the employer did not ensure a "competent person" inspected trenches and excavations prior to the start of work and as needed throughout the shift.

29 CFR  1926.651(k)(2):Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety.  On or about August 24, 2023, and at other times thereafter, during a sewer line replacement at a worksite located near 270 N Main Street, Chagrin Falls, OH 44022, the employer did not remove an exposed employee from the hazardous area after indications of the failure of a protective system was identified by a "competent" person.

29 CFR  1926.652(a)(1):Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section:  On or about August 24, 2023, and at other times thereafter, during a sewer line replacement at a worksite located near 270 N Main Street, Chagrin Falls, OH 44022, the employer did not ensure an employee working inside a trench, with depths up to approximately 12.6 feet, was protected from cave-ins by an adequately designed protection system.  The soil would have been classified as; Type "B".

29 CFR  1926.652(b):The slopes and configurations of sloping and benching systems were not in accordance with the requirement options of 29 CFR 1926.652(b)(1), (b)(2), (b)(3), or (b)(4):  On or about August 24, 2023, and at other times thereafter, during a sewer line replacement at a worksite located near 270 N Main Street, Chagrin Falls, OH 44022, the employer did not ensure the 5-foot side wall directly above the trench box was properly sloped, exposing the employee working inside the trench to cave-in hazards.
