29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:  On June 6, 2017, at a tractor supply store new construction site on route 58 south of Wellington Township there was an active trench excavation project. The trench was approximately 10 feet deep with steel shoring securing the sides (trench box). The trench box did not have a ladder or other safe means of access/egress for an employee working at the base of the trench from inside the shoring.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:   On June 6, 2017, there was a 10 foot portable ladder placed into a shoring box for an employee to climb out of the 10 foot deep excavation at an active trench project. The ladder did not extend three feet above the upper landing surface edge.

29 CFR 1926.1053(b)(5)(i): Non-self-supporting ladder(s) were not used at an angle such that the horizontal distance from the top support to the foot of the ladder was approximately one-quarter of the working length of the ladder:   On June 6, 2017, there was a 10 foot portable ladder placed into a shoring box for an employee to climb out of the 10 foot deep excavation at an active trench project. The ladder was used  at approximately 90 degrees vertically from the ground below and placed next to the braces of the shoring box.

The base of the ladder was placed on an unleveled and unstable surface.

29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired:  On June 6, 2017, the employer provided a damaged and bent defective ladder for an employee to climb out of a shoring box that was protecting a 10 foot deep trench. One of the side rails for the top four rungs of the ladder were severely bent.
