29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a. An employee working near the grinder was exposed to noise on or about 1/25/12. The employee had a time weighted average of 87.6 dBA and a dose of 71.78% which is above the action level for hearing conservation program implementation. The total sampling time was 442 minutes with the remaining 38 minutes considered as zero exposure. b. An employee working near the grinder was exposed to noise on or about 1/25/12. The employee had a time weighted average of 88.9 dBA and a dose of 86.30% which is above the action level for hearing conservation program implementation. The total sampling time was 440 minutes with the remaining 40 minutes considered as zero exposure. The company did not develop and implement a hearing conservation program.
