29 CFR  1910.28(b)(1)(i):  Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i):  On or about November 9, 2022, the employer failed to ensure that employees who were feeding plastic parts into a grinder while working on elevated platforms (G1 and G2) were protected from falling approximately 7 feet to the concrete floor below. Employees were exposed to open, unprotected sides on elevated platforms and were not protected by guardrails or a fall protection system.

29 CFR 1910.28(b)(6)(i): The employer did not ensure that each employee less than 4 feet (1.2 m) above dangerous equipment is protected from falling into or onto the dangerous equipment by a guardrail system or a travel restraint system, unless the equipment is covered or guarded to eliminate the hazard.   On or about November 9, 2022, the employer failed to ensure that employees who were feeding plastic parts into a grinder while working on elevated platform G1 were protected from falling into dangerous equipment (grinder) which was approximately 36 inches below the working surface platform.

29 CFR  1910.29(b)(10):  The employer did not ensure that when guardrail systems are used at hoist areas, a removable guardrail section, consisting of a top rail and midrail, are placed across the access opening between guardrail sections when employees are not performing hoisting operations. The employer may use chains or gates instead of a removable guardrail section at hoist areas if the employer demonstrates the chains or gates provide a level of safety equivalent to guardrails.   On or about November 9, 2022, the employer failed to ensure that employees are protected from a fall from height down onto a concrete ground 7 feet below the working platforms of G1 and G2.  The employer is using chains which are loosely connected, sometimes disconnected,  as well as in very close in proximity to the edge of the platform instead of a removable guard rail system.
