29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor was an alternative fall protection plan which meets the requirements of 1926.502(k) developed and implemented.                                                                                                               (a) Vega Construction, LLC @ 2540 Hudson St., Denver, CO 80207: On and before 1/25/12, the correcting employer did not ensure that sub-contracted employees utilized personal fall arrest systems. Sub-contracted employees engaged in roofing activities on a 5 in 12 pitch, single-family, residential roof. This condition exposed employees to a fall hazard of approximately 11ft.

29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them):    (a) Vega Construction, LLC @ 2540 Hudson St., Denver, CO 80207: On and before 1/25/12, the correcting employer did not ensure that safety inspections regarding the use of personal fall arrest systems were conducted.
