29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of the jobsite, materials, and equipment to be made by a competent person:     (a) Rocky Mountain Construction Company, 333 South Federal Blvd., Denver, CO 80205: On 1/31/2012, the employer did not ensure that a competent person conducted an inspection(s) of the jobsite to ensure that a fall protection system was utilized by employees to protect them from a fall hazard.  This condition exposed the employees to a fall hazard of approximately 8 feet.    Abatement note: The requirements and duties of a competent person are:    (1) A competent person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them.    (2) The competent person must understand and be able to carry out the tasks specified in the OSHA standard.  The competent person must have knowledge about fall protection systems or plans, and the safety program.

This condition exposed the employees to a fall hazard of approximately 8 feet.

This condition exposed the employees to a fall hazard of approximately 10 feet.

29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns:    (a) Rocky Mountain Construction Company, 333 South Federal Blvd., Denver, CO 80205: On 1/31/2012, the employer did not ensure employees wore protective helmets while working in areas where there was a possible danger of head injury.  An employee was working under other workers who were dumping material into a trash chute.  This condition exposed the employee to a head injury from falling material.
