29 CFR 1926.451(e)(1):     When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, sturcure, personnel hoist, or similar surface was not used.    a)  On or about 2/1/12 at a new house construction project located at 31 Caldwell Drive, West Seneca, New York; employees installing asphalt shingles on a new house were using a ladder jack scaffold to perform work and access the back of the house. The ladders supporting the scaffold were used as access causing the employees to climb around the platform.    NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.451(g)(1)(i):     Each employee on a boatswains' chair, catenary scaffold, float scaffold, needle beam scaffold, or ladder jack scaffold was not protected by a personal fall arrest system:    a)  On or about 2/1/12 at a new house construction project located at 31 Caldwell Drive, West Seneca, New York; employees installing asphalt shingles on a new house were using a ladder jack scaffold to apply shingles and access the roof. Employees were not using a personal fall arrest system.    NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.501(b)(13):     Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor  did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502.      a)  On or about 2/1/12 at a new house construction project located at 31 Caldwell Drive, West Seneca, New York; employees installing asphalt shingles on a new house with a piitch of approximately 9/12 and eave heights up to approximately 22 feet. The was no fall protection, in complete fall protection in place.    NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.1053(b)(1):     Where portable ladders were used for access to an upper landing surface and the ladders length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:    a) On or about 2/1/12 at a new house construction project located at 31 Caldwell Drive, West Seneca, New York; employees installing asphalt shingles on a new house were accessing the roof using an extension ladder placed under the soffit then climbing around and over the eaves.    NO ABATEMENT CERTIFICATION REQUIRED
