29 CFR 1910.272(j)(1): The employer did not develop and implement a written housekeeping program that establishes the frequency and method(s) determined best to reduce accumulations of fugitive grain dust on ledges, floors, equipment, and other exposed surfaces. (a) Mercer Landmark, Inc., 715 West Logan Street, Celina, Ohio: On or about February 8, 2012, at the work site located at 281 West Main Street, St. Henry, Ohio, the employer did not ensure that the written housekeeping program established the frequency and methods determined best to reduce accumulations of fugitive grain dust on exposed surfaces. Accumulations of dust were observed on the floor and ledges of the milling room.

29 CFR 1910.307(c): Equipment, wiring methods, and installations of equipment in hazardous (classified) locations were not intrinsically safe, or approved for the hazardous (classified) location, or safe for the hazardous (classified) location: (a) Mercer Landmark, Inc., 715 West Logan Street, Celina, Ohio: On or about February 8, 2012, at the work site located at 281 West Main Street, St. Henry, Ohio, the employer did not ensure that the electrical control panel for the RMS mill was safe to use in a hazardous location. The energized electric panel was located in a Class II, division 2 area and the touch screen had been removed from the door so that the panel was no longer safe to use in such an environment.
