29 CFR 1910.252(a)(2)(xiii)(D): The employer did not recognize its responsibility for the safe usage of cutting or welding equipment, and did not advise all contractors about flammable materials or hazardous conditions of which they may not be aware: (a) Mercer Landmark, Inc., 426 West Market Street, Celina, Ohio: On or about September 18, 2014, at the work site located at 417 West Market Street, Celina, Ohio, the employer did not advise the maintenance contractor performing repairs on bin #7 of the presence of combustible grain dust in the bin. An explosion occurred when the contractor began welding on the bin. Employees were at risk of serious injury from fire and deflagration hazards.

29 CFR 1910.272(i)(1): The employer did not inform contractors performing work at the grain handling facility of known potential fire and explosion hazards related to the contractor's work and work area: (a) Mercer Landmark, Inc., 426 West Market Street, Celina, Ohio: On or about September 18, 2014, at the work site located at 417 West Market Street, Celina, Ohio, the employer did not inform the maintenance contractor of the combustible dust hazards in the mill building and grain storage bins. An explosion occurred when the contractor was welding on the exterior of bin #7. Employees were at risk of serious injury from fire and deflagration hazards.
