29 CFR 1926.501 (b)(13) Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system. a) Allenhurst Avenue, Ocean, NJ: Employees were not utilizing fall protection when working from heights greater than 6 feet from the ground level. The employees were working at a height from the ground level ranging from approximately 11 feet to greater than 23 feet to the ridge of the residential structure. The employees were framing the home in particular they wedre working on the garage, observed on or about 2/9/12.

29 CFR 1926.503 (a)(1) The employer did not provide a training program for each employee who might was exposed to fall hazards that enabled each employee to recognize the hazards of falling and traine each employee in the procedures to be followed in order to minimize these hazards. b) Allenhurst Avenue, Ocean, NJ: The employer did not provide training to employees on the use of fall protection. The employer did not train the employees on the use, recognition of fall hazards, and when fall protection is required, observed on or about 2/8/12. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
