29 CFR 1926.95(a): Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact.      At the project site, on March 1, 2012, or at times prior thereto, an employee was operating a John Deere Backhoe, Model 710D, License Number 621 SEQ, with a defective seatbelt mechanism.  The employer failed to maintain the seatbelt mechanism in a reliable condition.  Seat belts are a component part of an operator restraint system that is designed to reduce the incidence and severity of injuries to the operator in the event of a accident, and that the failure to wear the seat belts that are provided in the backhoe increases the risk of injury to the operator in the event of an accident.
