29 CFR 1926.300(b)(1): When power operated tools were designed to accommodate guards, they were not equipped with such guards when in use: Inside the exchange, there was no guard on the cutting wheel of a 110 VAC Makita right angle cutter, model N9500N, exposing employees that used the right angle cutter to cut cement board to the hazard of striking against the cutting wheel.

29 CFR 1926.403(b)(2): Listed, labeled, or certified equipment was not installed and used in accordance with instructions included in the listing, labeling, or certification: Inside the exchange buildings, a 4 inch square metal electrical box was not used as designed as it lay on the floor instead of being mounted to a surface. The outlet in the box powered a 110 VAC Makita 100 mm right angle cutter, model N9500N, that was used to cut cement board. Employees were exposed to the hazard of contacting electricity.
