29 CFR 1926.451(a)(6): Scaffolds shall be designed by a qualified person and shall be constructed and loaded in accordance with that design. Non-mandatory Appendix A to this subpart contains examples of criteria that will enable an employer to comply with paragraph (a) of this section: (a) Brocc Framing, Inc. at 4421 E CR70, Wellington, CO 80549: On and before January 23, 2012, the exposing employer did not ensure that a scaffold platform attached to the forks of a rough terrain forklift which was used to raise and lower personnel onto the roof was designed by a qualified person. The Skytrak 6036 operator's manual states to use only an approved work platform for lifting and lowering personnel. In addition, the -inch OSB used as part of the platform floor was damaged. This condition exposed employees to a fall hazard of approximately 15 feet.

29 CFR 1926.760(a)(1): Each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet above a lower level shall be protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems or fall restraint systems: (a) Brocc Framing, Inc. at 4421 E CR70, Wellington, CO 80549: On and before January 23, 2012, the exposing employer did not ensure that employees installing insulation and metal roofing near the peak of the low slope roof on the commercial steel building were protected from fall hazards. Two employees were not wearing a fall harness or utilizing a fall protection system when performing this task. This condition exposed the employees to a fall hazard of approximately 23 feet on the east side of the building.
