29 CFR 1910.1026(d)(3): Performance-oriented option. The employer shall determine the 8-hour TWA exposure for each employee on the basis of any combination of air monitoring data, historical monitoring data, or objective data sufficient to accurately characterize employee exposure to chromium (VI). The employer relied on historial data for exposure determination that did not accurately characterize employee exposure in that employees were not consistently below the action level. Personal air monitoring conducted on February 13, 2005 revealed an employee was exposed to chromium VI at 4.9 micrograms per cubic meter and additional personal air monitoring conducted on April 26, 2006 revealed the employee was exposed to hexavalent chromium at 2.5 micrograms per cubic meter and only one additional monitoring was conducted on May 12, 2006 which revealed an exposure of 1.3 micrograms per cubic meter.
