29 CFR 1926.95(a): Protective equipment, including personal protective equipment for the eyes, was not used where ever it was necessary by reason of hazards encountered in a manner capable of causing injury or impairment in the function of any part of the body through physical contact: a) Graduate Roofing Company, LLC, Rossford, Ohio: On or about March 7, 2012, at address 1239 Schreier Road, Rossford, Ohio, the employer failed to ensure that each employee used appropriate eye protection while engaged in nailing activities, such as securing shingles to the structure roof with a pneumatic nailer, exposing employees to eye injuries from flying particles.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above the lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems nor was another provision in paragraph (b) of this section provided. a) Graduate Roofing Company, LLC, Rossford, Ohio: On or about March 7, 2012 at address 1239 Schreier Road, Rossford, Ohio, the employer did not ensure that employees were protected from falls while applying new roofing materials to a steep sloped roof (8:12) on a residential type structure. Employees were exposed to a potential fall of approximately 10.3 feet to the ground below. Graduate Roofing Company, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA Inspection Number 313784332, citation number 1, item number 1 and was affirmed as a final order on October, 7, 2010, with respect to a workplace located at 215 E. Second Street, Perrysburg, Ohio.
