29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres and or other hazardous conditions: (a) Valencia Construction Inc. at 3330 Hewitt St, Loveland, CO 80538: On March 13, 2012, the exposing employer did not ensure that daily inspections of the basement excavation, and the adjacent area were made by a competent person for evidence of a situation that could have resulted in a hazardous condition, in that the soil on the west side was undercut due to sloughing the previous day. The depth of the west side of the excavation was approximately 7.5 feet and the horizontal distance from the side of the excavation to the formwork was approximately 4.5 feet. This condition exposed employees erecting concrete forms on the west side to crushing hazards by excavation wall cave-in.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c): (a) Valencia Construction Inc. at 3330 Hewitt St, Loveland, CO 80538: On March 13, 2012, the exposing employer did not ensure that each employee working between the vertical side of the excavation and the concrete formwork on the west side of the basement excavation was protected from cave-in. The soil on the west side was undercut due to sloughing the previous day. The depth of the west side of the excavation was approximately 7.5 feet and the horizontal distance from the side of the excavation to the formwork was approximately 4.5 feet. This condition exposed employees erecting concrete forms on the west side to crushing hazards by excavation wall cave-in.
