OSH ACT of 1970 Section (5)(a)(1):     Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to Struck by hazards caused by the misuse of a powered industrial vehicle.     Employees were using a Pettibone 636 Rough Terrain Forklift to pull a JLG boomlift out of the mud with the hydraulics of the mast.      Among other methods, feasible and acceptable means of abatement include:     A) Following the cautions, warnings and Theory of Operation statement contained in the Operators Manual for the Pettibone 636 Extendo rough terrain forklift.     B) Follow the towing precautions and procedures contained in the Operator's Manual for the the JLG 400S boomlift.      C) Use a piece of equipment designed and intended for pulling loads to pull the JLG 400S boomlift out of the mud.

29 CFR 1926.602(d):     The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l):   "AND AS REFERENCED BY THE NOTE CONTAINED IN 1926.602(d)"    The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178.      A) Employees operating rough terrain forklifts were not trained to understand the information contained in the operator's manual for the equipment as required by 1910.178(l)(3)(i)(m).    B) The employer did not maintain records of training for the employees operating rough terrain forklifts as required by 1910.178(i)(6).

29 CFR 1926.251(a)(6):     Each day before being used, and during use, where service conditions warrant, the sling and all fastenings and attachments were not inspected for damage or defects by a competent person, and damaged or defective slings were not immediately removed from service:    Synthetic slings being used to lift the scaffold wagon and wire rope slings being used to pull a boomlift out of the mud were all damaged.

There were other ironworkers and emplyees of the roofing contractor within the fall zone of the crane while the load was being lowered into the landing area.

29 CFR 1926.760(a)(1):     Each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems.    An employee was standing outside of the warning line on the edge of the roof of the building directing the crane operator to land the scaffold wagon on the roof.     Pro-Type Builders, Inc was previously cited for a violation of this Occupational Safety and Health Standard, or an equivalent Standard (1926.501(b)(10)) which was contained in OSHA Inspection Number 312552789, Citation #1, Item #1, and was affirmed as a Final Order on 8/25/2009 with respect to a workplace located at 1516 Fernando Dr, Ashwaubenon, WI 54303.
