29 CFR 1926.760(a)(1):Except as provided by paragraph (a)(3) of this section, each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level shall be protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems or fall restraint systems. On or about January 29, 2024, with respect to a worksite located at 733 Midway Road, Menasha, WI 54952, the employer did not ensure that employees were protected from fall hazards of up to 32 feet while conducting trim work on a new commercial steel erection project.

29 CFR 1926.451(e)(1):When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall be used. Crossbraces shall not be used as a means of access. On or about January 29, 2024, with respect to a worksite located at 733 Midway Road, Menasha, WI 54952, an employee accessing a JLG Model RT4769 Rough Terrain Scissor Lift was not provided with a safe means of egress from the roof edge into the basket of the Scissor Lift and climbed onto the top and mid rail of the basket while accessing the lift.

29 CFR 1926.602(c)(1)(ii): No modifications or additions which affect the capacity or safe operation of the equipment shall be made without the manufacturer's written approval. If such modifications or changes are made, the capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly. In no case shall the original safety factor of the equipment be reduced. On or about January 29, 2024, with respect to a worksite located at 733 Midway Road, Menasha, WI 54952, the employer used a self made man basket attached to a SkyTrak Model 6036, Serial # 1599 to lift personnel conducting trim siding applications. The basket had not been made, or used, with the written approval of the manufacturer.
