29 CFR 1910.95(c)(1): A continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (n) was not instituted when employee noise exposures equaled or exceeded an 8-hour time weighted average sound level (TWA) of 85 dBA or 50% of the permissible exposure limit of 90 dBA: a. An employee required to operate Press No. 31 was exposed to continuous noise at 158.9% of the permissible daily noise exposure (8-hour time-weighted average sound level of 90 dBA) during the 434 minute sampling period on April 26, 2012; exposure calculations include a zero increment for the 46 minutes not sampled. b. An employee required to operated Press No. 35 was exposed to continuous noise at 156.6% of the permissible daily noise exposure (8-hour timje-weighted average sound level of 90 dBA) during the 404 minute sampling period on April 26, 2012; exposure calculations include a zero increment for the 76 minutes not sampled. c. An employee required to operate Press No. 33 was exposed to continuous noise at 115.9 % of the permissible daily noise exposure (8-hour time-weighted average sound level of 90 dBA) during the 415 minute sampling period on April 26, 2012; exposure calculations include a zero increment for the 65 minutes not sampled. The employer had not instituted a continuing, effective hearing conservation program.
