At W9517 Hwy 64W Pound, WI, employees are exposed to at least one rotating sweeper conveyor and three pinch points. Some of these locations had been guarded in the past, but the guards had been removed and not replaced. To abate this violation, the employer must guard all rotating parts and pinch points. 29 CFR 1910.213(i)(1): Non-working portion(s) of the blade of bandsaw(s) are not enclosed or guarded: The employer does not provide machine guarding to protect employees from hazards related to unguarded non-working portions of the blades running on the McDonough re-saw. At the McDonough re-saw, employees are exposed to unguarded rotating parts. These locations have not been guarded in the past. This violation was must recently observed on April 25th, 2012, when the re-saw operator was utilizing re-saw with no guarding above the feed roller on the front or rear of the saw blade. The operator was within 4 inches of the running saw blade and not protected by a shield or guard. To abate this violation, the employer must guard or enclose all non-working portions of the blade and take steps to ensure that the guards remain in place while employees are in the area. At the Cornell trim saw, employees are exposed to at least three of the unguarded rotating saw blades. Some of these locations had been guarded in the past, but the guard had been moved and not replaced or adjusted properly. To abate this violation, the employer must guard all portions of the circular blades on the trim saw to reduce the cutting hazard and take steps to ensure that the guards remain in place while employees are working with the trim saw. 29 CFR 1910.147(c)(6)(i): The employer does not conduct an annual or more frequent inspection of the energy control procedure to ensure that the procedure and requirements of this standard were followed: The employer does not conduct periodic inspections of its energy control procedures to ensure that the procedures are correct and employees are utilizing them correctly. Employees continued to utilize deficient energy control procedures and are not adequately protected from un-expectant releases of hazardous energy. This violation was most recently observed on April 25th, 2012. To abate this violation, the employer must conduct periodic inspections of its energy control procedures and correct all application deficiencies to ensure employees are protected from hazardous energy during servicing and maintenance activities. Pursuant to 29 C.F.R. 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including a copy of its periodic inspections conducted, and an explanation of how it will ensure that periodic inspections are conducted on at least an annual basis. 29 CFR 1910.147(f)(3)(ii): Group lockout or tagout devices are not used in accordance with procedures required by 29 CFR 1910.147(c)(4): The employer does not require employees to utilize group lockout tagout procedures when more than one is actively involved in a servicing and/or maintenance activity. The employers energy control procedures does not include specific steps to implement group lockout tagout procedures to ensure that each employee involved is afforded individual protection from hazardous releases of energy. This violation was most recently observed on April 25th, 2012 when two employees were involved in adjusting the position of a trim saw blade with only one lock applied to the electrical disconnect. To abate this violation, the employer must develop group lockout tagout procedures and ensure that employees working together on servicing or maintenance activities each utilize lockout tagout procedures. Pursuant to 29 C.F.R. 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including a description of how these steps are protecting each employee from the un-expectant release of hazardous energy. 29 CFR 1910.132(a): Protective equipment is not used when necessary whenever hazards capable of causing injury and impairment were encountered: Each employee ascending the inclined sweeper conveyor, with unprotected sides and edges, is not protected from falling up to 13.5 feet to the ground, by the use of guardrails or a harness and lanyard. The employer does not require the use of any form of fall protection during maintenance activities where employees are elevated above 4 feet. To abate this violation, the employer must ensure that its employees performing maintenance work on an elevated surface above 4 feet are protected from falls and that no employee is allowed onto an elevated surface more than 4 feet high without adequate fall protection. Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including a description of how these steps are protecting employees from falls from the inclined open sided sweeper conveyor.
