29 CFR 1910.106(e)(2)(iv)(a): Flammable liquids were not kept in covered containers when not actually in use:  At the Rig 1 drilling site located at Adele DuBose #2 Well in Gonzales County, Texas, on or about March 22, 2012 and at times prior thereto, open containers of flammable solvents in the Parts House were used for soaking paint brushes after use by employees on the rig.   Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that flammable liquids are kept in covered containers when not actually in use.

29 CFR 1910.133(a)(1):   The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  At the Rig 1 drilling site located at Adele DuBose #2 Well in Gonzales County, Texas, on or about March 22, 2012 and at times prior thereto, employee(s) were wearing non-safety type prescription glasses in lieu of appropriate personal protective equipment for eyes and/or face, such as safety glasses with sideshields, while tripping pipe on a well, exposing employees eyes to the hazards of being struck by flying or falling particulates.   Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.

29 CFR 1910.1200(f)(5)(ii): The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the appropriate hazard warnings:  (a) At the Rig 1 drilling site located at Adele DuBose #2 Well in Gonzales County, Texas, on or about March 22, 2012 and at times prior thereto, employees were dispensing hydraulic oil, motor oil and gear oil from lube oil storage bins that were not labeled with hazard warnings.   (b) At the Rig 1 drilling site located at Adele DuBose #2 Well in Gonzales County, Texas, on or about March 22, 2012 and at times prior thereto, employees were dispensing combustible diesel fuel from a skid-mount storage tank for use in mud mixing operations, and the tank was not labeled with the hazard warnings.  (c) At the Rig 1 drilling site located at Adele DuBose #2 Well in Gonzales County, Texas, on or about March 22, 2012 and at times prior thereto, in the Parts House, plastic containers with brushes soaking in flammable solvent were not labeled with hazard warnings. 29 CFR 1910.1200(g)(1): The employer did not have a material safety data sheet for each hazardous chemical which they used:   At the Rig 1 drilling site located at Adele DuBose #2 Well in Gonzales County, Texas, on or about March 22, 2012 and at times prior thereto, the employer did not have material safety data sheets for employees who were using hazardous chemicals for rig maintenance including, but not limited to, flammable Crown Xylol (Xylene)  Thinner, flammable Sunnyside Denatured Alcohol, Sigma Vikote 56 Safety Red, Rust-Oleum Bar-B-Q Black (petroleum distillates), and Jones Blair 45015 Acrylithane C-HS Enamel Neutral Base and 99979 Acrylithane C-HS Catalyst (1,6-diisocyanate hexane; ethyl benzene).  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that the employer has a material safety data sheet for each hazardous chemical which they use.

29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  At the Rig 1 drilling site located at Adele DuBose #2 Well in Gonzales County, Texas, on or about March 22, 2012 and at times prior thereto, where the employer required use of Moldex 2300 N95 series filtering facepiece respirators for employees who were adding dry bulk materiasl to mud mixers containing hazardous components including, but not limited to, crystalline silica and caustic soda, the employer did not develop and implement a written respiratory protection program.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that a written respiratory protection program that includes the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures is established and implemented for required respirator use.

29 CFR 1910.134(f)(2): The employer did not ensure that an employee using a tight-fitting facepiece respirator was fit tested prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) is used, and at least annually thereafter:  At the Rig 1 drilling site located at Adele DuBose #2 Well in Gonzales County, Texas, on or about March 22, 2012 and at times prior thereto, where employees were required to wear Moldex 2300 N95 series filtering facepiece respirators while adding bags of dry chemicals to mud mixing hoppers containing hazardous components including crystalline silica and caustic soda, employees were not provided initial and annual respirator fit testing.   Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that an employee using a tight-fitting facepiece respirator is fit tested prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) is used, and at least annually thereafter.
