29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet(1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provisionin paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it isinfeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets therequirements of paragraph (k) of 1926.502.    a.  On or about April 24, 2012 - at the above addressed jobsite, employees performing roofing operations on a roof approximately twenty five (25) feet above the ground were not protected from falls, thereby exposing employees to fall hazards.

29 CFR 1926.502(e)(2): Positioning devices shall be secured to an anchorage capable of supporting at least twice thepotential impact load of an employee's fall or 3,000 pounds (13.3 kN), whichever is greater.    a.  On or about April 24, 2012 - at the above addressed jobsite, employee performing roofing operations, approximately twenty five (25) feet above ground, was not secured to an anchor capable of supporting at least twice the potential impact load of an employee's fall, employee's anchor point was another employee who was holding on to the life rope, thereby exposing the employee to a fall hazard.
