Section 5 (a) (1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the recognized hazards of lacerations, fractures, and death associated with the hazard of falls:    For work performed on or about on September 7, 2008, at restaurant renovation site, the  employer allowed an employee to stand on a pallet and be elevated on the forks of a forklift to access a scaffold, exposing the employee to the hazard of falls.
