29 CFR 1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).  (a)  Construction site - On or about September 3, 2014 the employer did not ensure training for an employee prior to operating a forklift. The forklift driver hoisted an employee on an unauthorized wooden pallet.

29 CFR 1926.25(a): During the course of construction, alteration, or repairs, form and scrap lumber with protruding nails, and all other debris, shall be kept cleared from work areas, passageways, and stairs, in and around buildings or other structures.  (a)  Construction site - On or about September 3, 2014 employees were exposed to multiple fall and puncture hazards while working because the employer did not clear the work area of unnecessary tripping hazards.  Employees were exposed to nails and boards throughout the job-site.

29 CFR 1926.102(a)(1): Employees shall be provided with eye and face protection equipment when machines or operations present potential eye or face injury from physical, chemical, or radiation agents.  (a)  2nd floor - On or about September 3, 2014 employees were exposed to a flying object hazard while using nail guns.  None of these employees were wearing eye protection.  The employer did not enforce the wear safety glasses on this jobsite.

29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment shall not be used to support scaffold platforms unless they have been specifically designed by the manufacturer for such use.  (a)   Left of the building - On or about September 3, 2014 an employee was exposed to a fall hazard while riding in an unauthorized wooden pallet used as scaffold. This pallet was airlifted by a Genie GTH-5519 Forklift serial no. 0302. This pallet was not designed by the manufacture to transport employees.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers. Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs, and other elevated surfaces are set forth in subpart M of this part.  (a)  Left of the building - On or about September 3, 2014 an employee was exposed to a fall hazard while riding in an unauthorized wooden pallet used as scaffold. This pallet was airlifted by a Genie GTH-5519 Forklift serial no. 0302.  This employee was airlifted 16 feet above the ground with no fall protection.

Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  (a)  2nd floor - On or about September 3, 2014 an employee was exposed to a fall hazard while standing in a window 16 feet above concrete with no fall protection.
