OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees (a) In Bay 1, Renfroe Model FR Clamp (1/2 Ton, 0-3/4") was used to move steel plates. The clamps were not used in accordance with the instruction manual in that it was used for vertical lifts and turned into a horizontal lift.

29 CFR 1910.23(c)(1): Open-sided floor(s) or platform(s) 4 feet or more above the adjacent floor or ground level were not guarded by standard railings (or the equivalent as specified in 29 CFR 1910.23(e)(3)(i) through (v)), on all open sides: (a) In Bay 3 East, the Impacter model 4800 had final assembly on the platform which was approximately 6' above the floor. Employees used the scissors lift to the elevation and then went around to get on the platform. Employees were exposed to fall hazards.
