29 CFR 1915.71(b)(5):     Scaffolds shall be maintained in a safe and secure condition. Any component of the scaffold which is broken, burned or otherwise defective shall be replaced.    Small railway:  On or about May 3, 2012 and times prior thereto, the nails that held down the planks were sticking up a 1/2 inch.  This condition exposed employees to trip hazards and falling off the scaffold while working.

29 CFR 1915.71(c)(1):     All pole uprights shall be set plump. Poles shall rest on a foundation of sufficient size and strength to distribute the load and to prevent displacement.      Large railway:  On or about May 3, 2012 and times prior thereto, at the stern of the vessel scaffold legs were set in the silt with no base plates or mudsills.  This exposed employees to a fall of over ten feet if the scaffold were to collapse due to unfirm footings.

29 CFR 1915.71(j)(1):     Scaffolding, staging, runways, or working platforms which are supported or suspended more than 5 feet above a solid surface, or at any distance above the water, shall be provided with a railing which has a top rail whose upper surface is from 42 to 45 inches above the upper surface of the staging, platform, or runway and a midrail located halfway between the upper rail and the staging, platform, or runway.    Large railway:  On or about May 3, 2012 and times prior thereto, the scaffolding used to work on the vessel had no rails installed at heights from 6 to 10 feet.  This exposed employees to falls of greater than 6 feet.

29 CFR 1915.71(k)(2):     Ramps and stairways shall be provided with 36-inch handrails with midrails.    (a)  Small railway:  On or about May 3, 2012 and times prior thereto, the ramp up to the vessel had no rails installed.  This exposed employees to a 11 foot fall at the top of the ramp.    (b)  Large railway:  On or about May 3, 2012 and times prior thereto, the ramp up to the vessel had no rails installed.  This exposed employees to a 14 foot fall at the top of the ramp.

29 CFR 1910.213(b)(3):     On applications where injury to the operator might result if motors were to restart after power failures, provision shall be made to prevent machines from automatically restarting upon restoration of power.    (a)  Main shop:  On or about May 3, 2012 and times prior thereto,  the wood working table saw did not have a system installed to keep the saw from restarting.  This exposed employees to cuts and possible amputations to the hands if the machine automaticaly started after a power failure.     (b)  Main shop:  On or about May 3, 2012 and times prior thereto,  the wood working band saw did not have a system installed to keep the saw from restarting.  This exposed employees to cuts and possible amputations to the hands if the machine automaticaly started after a power failure.     (c)  Main shop:  On or about May 3, 2012 and times prior thereto,  the wood working planner did not have a system installed to keep the saw from restarting.  This exposed employees to cuts and possible amputations to the hands if the machine automaticaly started after a power failure.

29 CFR 1915.507(b)(1):     The employer must select, install, inspect, maintain, and test all portable fire extinguishers according to NFPA 10-2002 Standard for Portable Fire Extinguishers (incorporated by reference, see  1915.5).    a)  Boatyard:  On or about May 3, 2012 and times prior thereto, none of the fire extinguishers had 30 day inspections completed.  This exposed employees to smoke inhalation hazards from fighting fires with a fire extinguisher that may not work.
