OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: Big Side: On or about January 18, 2017 and at times prior thereto, a 54 inch section of top and midi-rail of the standard guardrail were removed which created an open-sided platform. This condition exposed employees to a fall hazard of 10 feet. Among other methods, a means of correcting this hazard would have been to reinstall the top and mid-rails of the standard guardrail to enclose the open-sided platform.
