29 CFR 1926.552(a)(1): The employer did not comply with the manufacturer's specifications and limitations applicable to the operation of all hoists and elevators. Where manufacturer's specifications were not available, the limitations assigned to the equipment were not based on the determinations of a professional engineer competent in the field: a) Roofing materials were being used as counterweighting for a hand powered hoist being operated at the site. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.501(b)(3): Each employee in a hoist area was not protected from falling 6 feet (1.8m) or more to lower levels by guardrail systems or personal fall arrest systems: a) Employees were exposed to the hazard of falling approximately 25 feet while working in a hoist area and operating a hand powered hoist along the rear elevation of the building. b) Employees were exposed to the hazard of falling approximately 25 feet while working in a hoist area during the crane delivery of materials to the roof deck. Smart Roofing, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501 (b)(3) which was contained in OSHA inspection number 312320492, citation 1, item 2, issued on August 1, 2008 and became final order on or about August 2, 2008. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
