29 CFR  1926.451(a)(6):Scaffolds were not constructed in accordance with the design by a qualified person:  On or about November 2, 2021 a job made box (scaffold) was attached to the forks of a rough terrain fork truck.  The scaffold was not constructed and designed by a qualified person, exposing an employee to a fall of over 20 feet.  Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR  1926.502(d)(15):Anchorage used for attachment for personal fall arrest equipment was not capable of supporting at least 5,000 pounds (22.2 kN) per employee attached nor was it designed, installed and used as follows: As part of a complete personal fall arrest system which maintains a safety factor of at least two; and under the supervision of a qualified person:  On or about November 2, 2021, two workers were attached to one roof anchor, exposing employees to a fall hazard of 13 feet, as the roof anchor would not support 5,000 pounds per worker and was not installed per the manufacturers specifications.   Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  On or about November 2, 2021 an employee was not protected from a fall while engaged in residential roofing operations, exposing them to a 13 foot fall.  Smart Roofing, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR  1926.501(b)(10), which was contained in OSHA inspection number 1291199, citation number 1, item number 3 and was affirmed as a final order on March 15, 2018, with respect to a workplace located at 322 Ogden Ave. Westmont, IL 60559.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).
