OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees in that employees were exposed to the hazard of inhalation of anhydrous ammonia from potential releases from the ammonia refrigeration system. (a) Anhydrous Ammonia Refrigeration System: On or about 5-8-12, a Hansen Technologies Float Switch was observed with significant rust accumulated on the tank assembly. Pepsi Beverages Co. did not have a program of scheduled inspections of the system to ensure that the system and its individual components were in proper working order and suitable for continued service.

29 CFR 1910.137(b)(2)(viii): Electrical protective equipment was not subjected to periodic electrical tests in accordance with Tables I-5 and I-6: (a) Maintenance shop: The Salisbury class 00 electrical protective gloves in service and being used by a maintenance mechanic were last tested on 6-13-11, and not tested at least every six months as required by Table I-6, on or about 5-8-12.
